UCBerkeley Professor DeLong calls for John Yoo’s job


In this letter, UC Berkeley Professor Brad DeLong calls for UC Berkeley to fire his UC Berkeley colleague, John Yoo, concluding:

I am not an international law professor.  I am not a moral philosophy professor.  I am just an economics professor.  I am aware that my conclusions [as supported in his letter] may be wrong.  It is the fact that my conclusions may be wrong [that] has led me to dither about this matter up till [sic] now.

But with the OPR[*] report I see no choice; so I ask you, out of a concern for justice, a concern for humanity, and a concern for our reputation as a university, to dismiss Professor John Yoo from membership in our university.

I encourage Prof. DeLong to continue this effort to remove Mr. Yoo from the Berkeley staff but note that his argument would be strengthened if Mr. Yoo were first disbarred as a practicing attorney.

  1. I think John Yoo’s standing with the bar is very iffy to start with. Not even sure he was technically a member of the bar when he advised bush.

    Great post… I hadn’t heard about this. This also illustrates why I hate fake liberal bastions like UC-Berkeley. Jesus christ it’s like Duke hiring Goebbels as a PoliSci professor in 1946.

  3. Well done, DeLong! It seems a mass insanity that this isn’t viewed as a top priority!

    I did a bit the other day on the UCDavis Guantanamo Testimonial Project and had no problem getting in a jab on Berkeley for continuing to have Yoo as part of their staff. It’s unbelievable.

  4. It’s embarrassing to me that this call for Mr. Yoo’s job is not coming from his law school colleagues but is instead coming from a non-lawyer professor employed in a non-legal curriculum.

  5. “Just an economics professor.” That’s De Long.

    Happy to see him taking this stand. He’s been more than reasonable about it. I think the attempts he’s made in the past to engage the law school and his faculty colleagues at Berkeley on this are more than adequate, and he has been very sensitive to the academic freedom issues.

    Agree that his hand would be greatly strengthened if Yoo were disbarred. (And would disbarment. in and of itself, disqualify him from teaching?)

    If I were looking at this as a matter of what’s good for the institution, I would be wanting to move Yoo out. They are in real danger of ending up on the wrong side of history here, if they aren’t there already. They are going to take a beating on this if the efforts to investigate all this, disclose the secret documents, force people to testify, etc. are successful (I hope they are successful), and falling back on academic freedom isn’t going to help matters one bit.
